Terms of Service

Welcome to PenK Assistant! These Terms of Service ("Terms") govern your use of PenK Assistant, a productivity app provided by Flowerz ("we," "us," or "our"). By using PenK Assistant, you agree to these Terms. If you don't agree, please don't use the app.
1. Eligibility
- PenK Assistant is suitable for users aged 4 and up. For users under 13, parental consent is required. If under 18, parental guidance is recommended.
- Keep your account secure (e.g., don't share your password).
2. License to Use
- We grant you a non-exclusive, non-transferable license to use PenK Assistant for personal, non-commercial purposes, subject to these Terms.
- You may not copy, modify, distribute, or reverse-engineer the app.
3. Your Responsibilities
- Acceptable Use: Use PenK Assistant lawfully. Don't upload harmful content (e.g., malware, illegal material) or abuse features (e.g., spamming the Chat Assistant).
- Data Accuracy: You're responsible for the accuracy of the data you input (e.g., Habits, Metrics, Goals).
4. Features
- Features: We offer Stat Tracking, Goal Tracking, To-do Lists, Habit Tracking, Focus Timer, Reminders, Calendar integration, Analytics, and a Chat Assistant. Features may change or require updates.
- Availability: We may modify or discontinue features at our discretion.
5. Subscriptions, Payments, and Refunds
PenK Assistant offers free and paid plans.
- Free Plan: The PenK Free plan is offered at no cost and is subject to the limitations described on our pricing page.
- Pro Subscriptions: PenK Pro is available on a monthly or annual subscription basis. Payments are billed in advance on a recurring basis. Your subscription will automatically renew at the end of each billing cycle unless you cancel it through your account settings.
- PenK Lifetime Partner Plan:
- This plan is acquired through a one-time payment.
- "Lifetime" refers to the operational lifetime of the PenK Assistant product. It is not tied to the lifetime of the user.
- Service Discontinuation Policy: We are building PenK for the long term. However, in the unlikely event that we must permanently discontinue the PenK Assistant service, users who purchased a Lifetime Partner plan are eligible for a pro-rated refund if their purchase was made within 36 months (3 years) of the discontinuation date.
- Refund Calculation: The refund will be calculated linearly based on the following formula:
Refund = Purchase Price * ( (36 - Months Since Purchase) / 36 ). For example, a user who purchased the plan 12 months prior to discontinuation would receive a 2/3 refund. - After 36 months from the date of purchase, the plan is considered fully rendered and is no longer eligible for a refund in the event of service discontinuation.
- General Refund Policy: All payments are final and non-refundable, except as explicitly stated in our "Service Discontinuation Policy" for the Lifetime Partner plan or as required by applicable law.
- Fee Changes: We reserve the right to change our subscription fees. We will provide you with reasonable prior notice of any fee changes.
6. Third-Party Services
- PenK Assistant integrates with Google Calendar. Your use of Google services is subject to Google's terms.
- We're not responsible for third-party services' performance or policies.
7. Intellectual Property
- We own PenK Assistant, including its design, code, and Analytics insights. Your data (e.g., Habits, Goals) remains yours, but we can use it as per our Privacy Policy.
- Don't use our trademarks or content without permission.
8. Termination
- You can stop using PenK Assistant by deleting your account.
- We can suspend or terminate your access if you violate these Terms or for any reason (e.g., maintenance), with or without notice.
9. Disclaimers
- PenK Assistant is provided "as is." We don't guarantee it'll be error-free or always available.
- We're not liable for losses from your use (e.g., missed Reminders or data errors).
10. Limitation of Liability
- To the fullest extent permitted by law, Flowerz shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill.
- Our total liability to you for any and all claims arising from your use of the service is limited to the greater of:
- Fifty U.S. Dollars ($50.00)
- The total amount you have paid to us for subscriptions in the 12 months prior to the claim.
This limitation does not apply to our refund obligation for the PenK Lifetime Partner plan as detailed in Section 5.
11. Changes to Terms
- We may update these Terms and notify you (e.g., in-app or via email). Continued use means you accept the changes.

- These Terms are governed by the law of Vietnam. Disputes will be resolved in Vietnamese courts.
